General conditions of sale and use

Article 1: Scope

By validating the order, the customer declares to have read and accept these general conditions of sale.

Article 2: Conditioning

Our wines are mainly marketed individually because they are usually available in stock.

However, as soon as one of them is momentarily exhausted, we usually iron it for sale at the original packaging by 3, 6, 12 or 24.

In this case, if you want a lower packaging, please contact us to let us know your request.

Although the packing is modifiable, we will have no obligation to sell these products to the unit.

Some wines are indicated in wooden case. We only ship these wines in wooden crates from orders for 24 bottles, as these can only be shipped by carrier to ensure they arrive in perfect condition. Below this threshold, the bottles are packed in secure cartons.

Article 3: Order

All our offers are valid while stocks last.

Any order will be taken into account only after acceptance of the payment by our banking organization. We reserve the right to cancel a non-compliant or questionable order.

Regarding wines limited to a certain number per customer and per order, we would like to specify that in case of several orders made by the same person, the same delivery address or the same bank card, a single order will be taken into account. The second (and possibly the following) will be refunded as a discount code to close the order and the first will be shipped. Same for references ordered beyond authorizations.

For payment by check, we will usually wait 10 days after the deposit of it, before making the shipment.

If an order is not withdrawn after one year, it will automatically be returned to the shelves. Same, for orders not finalized by the customer (payment, changes ...) In case the payment has already been cashed, the amount will be automatically converted into credit, valid for an unlimited period.

For orders where the delivery method is indicated: Withdrawal by hand or delivery postponed, it will be set aside for a withdrawal at our shop / warehouse of Annecy-Pringy (under 24 / 48h, working days), or for a later shipping, or to group to a next order. In the latter two cases, if the franc is not reached we will ask you to pay the shipping cost. In addition, the delivery postponed is free within the limit of 2 months (except July / August). Beyond this period, storage costs amount to € 1 per day and per order.

To trigger the delivery of orders carried, just send us an email a few days before (ideally a week) so that we finalize and we plan in our logistics planning. At certain times of the year, there may sometimes be a longer waiting period, especially at the beginning of September and December.

An order in free carriage must automatically be superior to an amount of 490 € (for metropolitan France).

Booking wishes: on many references exhausted or waiting for the arrival of the new vintage, you have the possibility to send us your reservation wishes by e-mail. Upon receipt of the references concerned, we will come back to you with a precise answer (confirmation volume, vintage, tariff). Then, free to you to formalize or not.

Note that for orders made in the shop or personalized by mail, the customer does not benefit from 2% Cashback fidelity.

For our Swiss customers in particular, it is possible, on request, to benefit from the tax refund (minimum order: 250 €). Important clarification, orders must be formalized in French TTC. Please send us by e-mail your proof of identity or passport at least 48 hours working days, before the withdrawal of the goods. French VAT will be refunded via a bank transfer to a French account or converted into a discount code (no time limit).

When we offer exceptionally a discount code offer, the codes are not cumulative (limited to 120 € per customer and per period of operation).

Article 4: Price

The prices indicated are expressed in euros and include all taxes.

Prices are net and excluding participation in shipping and delivery. Participation in shipping costs varies depending on the number of products ordered and the country of shipment.

Article 5: Delivery

Classic order (of products present in stock, indicated under each label):

Delivery in France: 1 to 3 working days (98%), 12 days maximum in very special cases

Delivery in Europe *: 3 to 6 working days depending on destination, after payment of shipping costs, maximum: 15 days.

Delivery postponed: You have the possibility to postpone the delivery of your order free of charge for a maximum period of 3 months from the date of order. The main interest of this postponed delivery is to be able to benefit from the shipping costs offered (490 € for France) by accumulating several orders during this period of 3 months. You can use this delivery method for any other reason, for example to avoid a heat spike during transport.

For delivery mode postponed, it is up to you to ask us to trigger the shipment, via a message stating it in your last order or via the contact form.

If you have not triggered your delivery at the end of the 2 months, we will offer 2 options (if you have not reached the carriage cost):

- proceed to the delivery of your order (s) after payment of shipping costs

- offer you our storage service in our air-conditioned warehouse, service charged 1 € TTC * per order and per day of storage (insurance included), whatever the order. You decide when you want your order delivered.

* Storage fees may change (guaranteed rate for 6 months minimum)

In case of heat wave - strong heat, the orders with sensitive references (ex: natural wines) are postponed in term of delivery when we judge the temperatures too high for the transport.

Possible option: Delivery upstairs with a surcharge of 25 € (for a maximum of 60kg)

Order with one or more products on order, requiring replenishment:

In this case, we call you, to inform you of the delays and to make a modification to your order if you wish it.

The maximum delivery date will then be indicated, before the final validation of your order.

At the time of delivery, check the contents of all packages and compare them with your order. In case of dispute make precise reservations in the presence of the deliveryman, on the delivery note that you must sign and call us within 48 hours. We will do what is necessary to rectify the problem as soon as possible and make the refund, if necessary, by check or by re-crediting your credit card.

Regarding the islands attached to a country for which shipping costs are calculated automatically, you may be asked additional shipping costs. In this case, you are free to cancel your order.

Article 6: Return

In application of the provisions of Article L.221-18 of the Consumer Code, the customer has a period of fourteen clear days from the date of receipt of order to inform us of its intention to retract (we send an email using the contact form). From this date you have 14 days to return the item delivered, in its original packaging, for exchange or refund, without penalty, except for the cost of return.

In case of defective bottles (corks, defects ...), please inform us by email as soon as possible or send them back to us quickly. It is preferable that these bottles still contain about 75% of the content with their original caps, because some winemakers wish to sometimes perform analyzes to know the causes.

Article 7: Applicable Rights and Dispute Resolution

Consumer mediation service:

Amicable settlement of disputes between the professional and the consumer in accordance with Articles L611-1 to L 641-1 and R 612-1 to R 616-2 of the Consumer Code.

In case of unresolved dispute between the Professional and the Consumer, the consumer has the possibility to seize the mediator of consumption.

Before entering the consumer mediator, the consumer must have already tried to resolve the dispute directly with the professional by a written complaint or have made a claim under the terms of the contract concluded with the professional.

The mediation of consumption is an out-of-court settlement of consumer disputes.

If the conditions are right, a mediation of the consumption will take place according to a precise process and according to the texts in force.

Article 8: Payment

The payment of the goods is made with the order by CB, check or transfer. For security reasons, credit card payments are limited to 1000 euros. Beyond the transactions are made by bank transfer only.

All flows of CB are done every day at midnight.

In some cases, we may need to request a payment by bank transfer, for orders under 1000 euros:

Champagnes, Spirits, prestigious wines or others.

Concerning the orders by check or transfer, without reception under 30 days, these will be automatically put on sale and canceled.

Article 9: Liability

The company has an obligation of results concerning the services offered to the customer under the contract concluded at a distance, however its responsibility can not be committed in case we could prove that the non-performance or the bad execution of the contract is imputable, either to the consumer, or to the fact, unpredictable and insurmountable, of a third party to the contract, or to a case of force majeure.

The photos and illustrations are provided for illustrative purposes and are provided by the suppliers. These may sometimes be different from those presented on the site (in case of doubt contact us).

Article 10: Protection of minors

In accordance with Article L.3342-1 of the Public Health Code, the sale of alcohol to minors under sixteen is prohibited, the buyer agrees to be sixteen years of age at the date of the order .

Remember that alcohol abuse is dangerous for your health: know how to consume in moderation.

Article 11: General Conditions of Use

Access to the Site "The Wine Enthusiasts" gives you, under our license, a private, non-collective and non-exclusive right to use the content of the "Les Passionnés du Vin" Website. Any networking and rebroadcasting, in any form, is prohibited.

The right to reproduce is for the purpose of representation on a single screen and is strictly reserved for your private use. If you wish to make a commercial use of the information appearing on this site, it is advisable to request an express agreement from the site "Les Passionnés du Vin".

All data published on the Site, including text, photographs, infographics, icons constitute works within the meaning of Article L 112-1 of the Code of Intellectual Property.
